Terms and Conditions for TurboApplication

1. Introduction & Acceptance of Terms
These Terms and Conditions ("Terms") govern the access to and use of the TurboApplication job application portal, including any associated websites, applications, software, and services (collectively, the "Service") provided by TurboApplication ("TurboApplication," "we," "us," or "our").
By creating an account, accessing, or using the Service, any individual or entity ("User," "you," or "your") agrees to be bound by these Terms and the TurboApplication Privacy Policy, which is published separately and incorporated by reference herein. These documents together form a legally binding agreement between you and TurboApplication. If you do not agree to these Terms or the Privacy Policy, you must not access or use the Service.
The Service is intended solely for Users who are at least eighteen (18) years of age or the legal age of majority in their jurisdiction of residence, whichever is greater. TurboApplication does not permit individuals under this age to use the Service.
TurboApplication reserves the right to modify, amend, or update these Terms at its sole discretion at any time. Users will be notified of any material changes to these Terms, for example, via email or a conspicuous notification within the Service. Continued use of the Service after such modifications have been communicated and have taken effect will constitute acceptance of the revised Terms. It is the User's responsibility to review these Terms periodically for any changes.
2. Definitions
For the purposes of these Terms, the following definitions shall apply:
- Service: The TurboApplication platform, encompassing all its features, functionalities, content, application programming interfaces (APIs), and associated services as described herein and in any accompanying documentation, designed to connect Companies/Employers with Job Candidates.
- Platform: The underlying technology, infrastructure, software, and systems that constitute and operate the TurboApplication job application portal.
- User: Any individual or entity that accesses or uses the Service, including but not limited to Companies/Employers, Job Candidates, Team Members, and Platform Administrators.
- Company/Employer: An entity, organization, or individual acting in a professional capacity that uses the Service to post job listings, manage applications, communicate with Candidates, and recruit and hire personnel.
- Job Candidate/Candidate: An individual who uses the Service to search for employment opportunities, create a profile, submit applications for positions, upload CVs/resumes, and manage their job applications.
- Team Member: An employee, contractor, or other authorized representative of a Company/Employer who is granted access to the Company's/Employer's Team Account with specific permissions to use the Service on behalf of that Company/Employer.
- Platform Administrator: Authorized personnel designated by TurboApplication responsible for the overall management, maintenance, and administration of the Service.
- Account: The registered account created by a User, whether a Personal Account or a Team Account, to access and use specific features of the Service.
- Personal Account: An Account established by an individual Job Candidate for their personal job-seeking activities.
- Team Account: An Account established by a Company/Employer, which may permit access and use by multiple authorized Team Members, subject to role-based permissions.
- User Content: Any and all information, data, text, files (including CVs/resumes, cover letters), images, audio, video, job descriptions, screening questions, application responses, messages, company profiles, and other materials or content that a User submits, posts, uploads, transmits, or otherwise makes available through the Service.
- TurboApplication IP: The Service, the Platform, the Documentation, Aggregated Statistics (as defined below), trademarks, logos, trade names, service marks, software, algorithms, designs, user interfaces, and any and all other intellectual property rights owned by or licensed to TurboApplication, provided to Users in connection with the Service, excluding User Content.
- Customer Data (for Companies): Information, data, and other content, in any form or medium, that is submitted, posted, or otherwise transmitted by or on behalf of a Company/Employer or its authorized Team Members through the Services, specifically related to their recruitment activities, including job postings and candidate applications they manage.
- Aggregated Statistics: Data and information related to Users' use of the Services that is collected by TurboApplication and used in an aggregate and anonymized manner, including to compile statistical and performance information related to the provision, operation, and improvement of the Services.
- Documentation: Any user manuals, handbooks, guides, and other materials relating to the Services provided by TurboApplication to Users, whether in electronic or hard copy form.
3. Account Registration & Management
To access and use many features of the Service, Users must register for an Account. Job Candidates will create Personal Accounts, while Companies/Employers will create Team Accounts.
- Information Accuracy: When creating an Account, Users agree to provide information that is true, accurate, current, and complete. Users further agree to maintain and promptly update this information to keep it true, accurate, current, and complete. Providing false, inaccurate, outdated, or incomplete information constitutes a breach of these Terms and may result in the immediate suspension or termination of the User's Account.
- Account Security: Users are solely responsible for safeguarding the confidentiality of their Account password and for any and all activities or actions that occur under their Account, whether or not they have authorized such activities or actions. Users must notify TurboApplication immediately upon becoming aware of any breach of security or unauthorized use of their Account. TurboApplication will not be liable for any loss or damage arising from a User's failure to comply with these security obligations.
- Prohibition on Sharing Credentials: Users agree not to disclose their Account password to any third party. Each User is responsible for their own Account credentials.
- Username Restrictions: Users may not use as a username the name of another person or entity, a name that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than the User without appropriate authorization, or a name that is otherwise offensive, vulgar, or obscene.
- Role-Based Access Control (RBAC): For Team Accounts, the Company/Employer is responsible for inviting and managing its Team Members. Different roles (e.g., Owner, Administrator, Member) with varying levels of permissions and access to features and data may be available. The Company/Employer is responsible for assigning appropriate roles to its Team Members and for all activities conducted by its Team Members through the Team Account.
- Multi-tenant Architecture: The Service operates on a multi-tenant architecture, meaning each Company/Employer typically has its own segregated portal or workspace within the Platform, enhancing data separation and customization capabilities.
4. Description of Services
TurboApplication provides an online platform designed to streamline the job application and recruitment process, connecting Companies/Employers with Job Candidates. The specific services and functionalities offered are detailed within the platform overview and include, but are not limited to, the following:

For Companies/Employers:
- Creation and management of comprehensive company profiles.
- Posting of job listings, including detailed descriptions, requirements, and compensation information (where applicable).
- Ability to add custom screening questions to job applications to filter and assess Candidates.
- Tools to review, manage, and track Candidate applications through various customizable stages (e.g., submitted, under review, interview, offer, hired, rejected).
- Capability to invite and manage Team Members to collaborate on the hiring process, with role-based permissions.
- Access to analytics and reporting features on job posting performance and recruitment metrics.
- Management of billing, subscriptions, and payment information.
- Options to set up custom domains for company-specific job portals, enhancing brand presence.

For Job Candidates:
- Browsing, searching, and filtering job opportunities posted by Companies/Employers.
- Submission of job applications, including the upload of CVs/resumes and other supporting documents.
- Answering pre-screening questions through a user-friendly interface (e.g., a Typeform-style experience).
- Tracking the status of submitted applications.
- Receiving notifications and updates regarding their applications and relevant job opportunities.

For Team Members:
- Collaborative tools for reviewing Candidate applications and making hiring decisions.
- Management of specific job postings assigned to them or within their purview.
- Access to company hiring data and analytics based on their assigned role and permissions.

For Platform Administrators:
- Overall management, maintenance, and support of the entire TurboApplication platform, ensuring its smooth operation and security.
5. Use of the Platform
5.1. License to Use
Subject to the User's compliance with these Terms, TurboApplication grants the User a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the Service solely for its intended purposes as outlined herein and in any accompanying Documentation. For Companies/Employers and their Team Members, this license is for internal business use related to recruitment and hiring. For Job Candidates, this license is for personal, non-commercial use related to seeking employment opportunities.
5.2. Acceptable Use Policy (AUP)
Users agree to use the Service in compliance with all applicable laws and these Terms. The following activities are strictly prohibited and constitute a misuse of the Service:
- Illegal Activities: Using the Service for any unlawful purpose, or in violation of any local, state, national, or international law.
- Infringement of Rights: Uploading, posting, transmitting, or otherwise making available any User Content that infringes upon or violates any patent, trademark, trade secret, copyright, privacy right, publicity right, or other proprietary or intellectual property right of any party.
- Harmful or Offensive Content: Transmitting or posting any material that is, or could be reasonably interpreted as, illegal, obscene, defamatory, libelous, threatening, harassing, abusive, hateful, discriminatory, or racially or ethnically offensive.
- Misrepresentation and Fraud: Posting false, inaccurate, or misleading information. Engaging in fraudulent activities, including impersonating any person or entity.
- Security Violations: Attempting to interfere with, compromise the system integrity or security of, or decipher any transmissions to or from the servers running the Service.
- Data Scraping/Mining: Using any automated system to access, scrape, or collect information or content from the Service in a manner that sends more request messages to the TurboApplication servers than a human can reasonably produce in the same period by using a conventional on-line web browser, except for legitimate search engine indexing for public search results.
- Resale or Commercial Exploitation: Reselling, sublicensing, leasing, or otherwise commercially exploiting the Service or any part thereof without the express prior written consent of TurboApplication.
- Discrimination: Using the Service to unlawfully discriminate against Job Candidates or any individuals based on any characteristic protected by applicable law.
- Spamming: Sending unsolicited commercial emails, bulk messages, or other forms of "spam" through or in connection with the Service.
User Responsibilities:
- Compliance with Laws: All Users are responsible for ensuring that their use of the Service complies with all applicable laws.
- Content Accuracy and Legality: Users are solely responsible for the accuracy, completeness, legality, and appropriateness of all User Content they submit.
5.3. Specific Terms for Companies/Employers
- Responsibility for Job Postings: Companies/Employers must ensure that all job postings are for legitimate, current, and bona fide employment opportunities and are accurate and non-misleading.
- Candidate Data Handling: Companies/Employers acknowledge they act as Data Controllers for Candidate Personal Data they process and are solely responsible for complying with applicable data protection laws (e.g., GDPR, CCPA). TurboApplication acts as a Data Processor on their behalf.
- Screening Questions: Companies/Employers are solely responsible for the content, legality, and appropriateness of any custom screening questions.
- Team Member Conduct: Companies/Employers are responsible and liable for all actions of their Team Members.
5.4. Specific Terms for Job Candidates
- Accuracy of Information: Job Candidates are solely responsible for the truthfulness, accuracy, and completeness of their submitted information.
- No Guarantee of Employment: TurboApplication does not guarantee job placement or employment offers. Employment decisions are made solely by Companies/Employers.
5.5. Specific Terms for Team Members
- Adherence to Company Policies: Team Members must use the Service in accordance with their employer's policies.
- Authorized Use: Team Members may only access and use data as authorized by their Company/Employer.
6. Fees, Payments, and Subscriptions (for Companies/Employers)
Current Service Status: TurboApplication is currently in a test phase and does not process payments at this time. Access to the Service is provided through approved free trial accounts only.
Future Payment Implementation: When payment processing becomes available, the following terms will apply:
- Subscription Plans: Various plans with different features, limits, and pricing will be made available.
- Payment Terms:
- Billing Cycle: Fees will typically be billed in advance (e.g., monthly, annually).
- Payment Methods: Payments will be processed through Stripe as the primary payment processor.
- Authorization: Companies/Employers will authorize TurboApplication and Stripe to charge applicable fees.
- Automatic Renewal: Subscriptions will automatically renew unless cancelled.
- Price Changes: TurboApplication may change fees with advance notice.
- Taxes: Fees will be exclusive of applicable taxes, which are the Company's/Employer's responsibility unless TurboApplication is obligated to collect them.
6.1. Refund and Cancellation Policy
- Cancellation: Companies/Employers can cancel subscriptions as instructed within the Service or via support.
- Refunds: As TurboApplication provides digital services, subscription fees are non-refundable except as required by applicable law.
7. Intellectual Property Rights
7.1. TurboApplication IP
- Ownership: The Service, Platform, and all associated intellectual property ("TurboApplication IP") are exclusive property of TurboApplication and its licensors.
- Restrictions: Users shall not copy, modify, reverse engineer, or resell any part of the TurboApplication IP.
- Feedback: Users grant TurboApplication a license to use any Feedback provided.
7.2. User Content
- Ownership: Users retain ownership of their User Content.
- License to TurboApplication: Users grant TurboApplication a license to use, host, store, reproduce, and modify User Content solely to operate, provide, and improve the Service.
- User Warranties for User Content: Users warrant they own or have rights to their User Content and that it doesn't infringe third-party rights or violate laws.
- Responsibility for User Content: Users are solely responsible for their User Content. TurboApplication may review and remove content violating these Terms.
8. Data Privacy and Data Protection
TurboApplication's collection, use, sharing, and protection of Personal Data are governed by the TurboApplication Privacy Policy, incorporated herein by reference.
GDPR Compliance: TurboApplication complies with the General Data Protection Regulation (GDPR) and other applicable European Union data protection laws. All personal data is stored and processed within the European Union to ensure compliance with data residency requirements.
Data Processing Addendum (DPA): For Companies/Employers subject to GDPR, a DPA will govern the processing of Candidate Personal Data where TurboApplication acts as a Data Processor. The DPA is available upon request or via the Service and forms part of the agreement.
9. AI-Powered Features
The Service uses Large Language Model (LLM) technology for CV analysis and processing, which may be provided by OpenAI or Google Vertex AI.
- Disclosure of AI Use: AI technology is used to analyze and process CVs, extract relevant information, and assist with candidate matching. AI may also pre-fill application fields based on CV content.
- User Acknowledgment and Consent: Use of AI features implies acknowledgment of this processing. Specific consent may be sought where required by law.
- No Guarantee of Accuracy or Outcomes: AI outputs are for assistance purposes only and are not guaranteed to be accurate, complete, or error-free.
- Human Oversight and Responsibility for Decisions: AI assists human decision-making processes. Companies/Employers retain full responsibility for all final hiring decisions. If AI leads to solely automated decisions with significant effects on individuals, GDPR Article 22 safeguards apply.
- Bias Mitigation: TurboApplication endeavors to mitigate bias in its AI systems and regularly reviews AI outputs for fairness.
- Data Processing: CV data processed by AI systems is handled in accordance with our Privacy Policy and GDPR requirements.
10. Third-Party Services & Links
The Service may integrate with or link to third-party services including but not limited to Supabase (database services), Stripe (payment processing), OpenAI or Google Vertex AI (AI services).
- Acknowledgment of Use: Users acknowledge and accept that the Service relies on such third-party services for its operation.
- No Endorsement or Responsibility: TurboApplication is not responsible for the availability, functionality, or policies of third-party services. Users access and use them at their own risk.
- User Interactions with Third Parties: Any interactions, transactions, or dealings with third-party services are solely between the User and the respective third party.
11. Confidentiality
- Definition of Confidential Information: Non-public information disclosed by one party to another.
- Obligations: Receiving Party will use Disclosing Party's Confidential Information solely for purposes of these Terms, protect it with reasonable care, and not disclose it to third parties except authorized Representatives.
- Exceptions: Obligations don't apply to information already known, publicly available without breach, rightfully received from a third party, or independently developed. Disclosure may occur if required by law, with prior notice if permissible.
- Duration: Obligations continue for Customer Data as long as retained, and for other Confidential Information for five years post-termination or disclosure.
12. Term and Termination
- Term: These Terms commence upon first use or Account creation and continue until terminated.
- Termination by User: Users may terminate their Account and these Terms at any time.
- Termination or Suspension by TurboApplication: TurboApplication may suspend or terminate Accounts immediately for breaches, non-payment, illegal activity, or service discontinuation.
- Effect of Termination: User's right to use the Service ceases. Outstanding payments remain due. Data deletion follows the Privacy Policy.
- Surviving Provisions: Certain sections (Definitions, Fees, IP, Privacy, Confidentiality, Disclaimers, Limitation of Liability, Indemnification, Governing Law, Miscellaneous) survive termination.
13. Disclaimers of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AND SECURITY.
TURBOAPPLICATION DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR MEET USER'S REQUIREMENTS.
- NO GUARANTEE OF OUTCOMES: TURBOAPPLICATION DOES NOT GUARANTEE EMPLOYMENT OR SUITABLE CANDIDATES.
- USER CONTENT AND INFORMATION ACCURACY: TURBOAPPLICATION DOES NOT GUARANTEE THE TRUTHFULNESS OR ACCURACY OF USER CONTENT. RELIANCE ON USER CONTENT IS AT USER'S OWN RISK.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TURBOAPPLICATION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL) ARISING FROM OR RELATING TO THE USE OF THE SERVICE, CONDUCT OF THIRD PARTIES, USER CONTENT, UNAUTHORIZED ACCESS, HIRING DECISIONS, OR ERRORS IN THE SERVICE.
TURBOAPPLICATION'S TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF FEES PAID BY THE USER IN THE PRECEDING SIX MONTHS OR $100.00.
THESE LIMITATIONS ARE AN ESSENTIAL BASIS OF THE BARGAIN.
15. Indemnification
Users agree to defend, indemnify, and hold harmless TurboApplication from any claims, damages, losses, liabilities, and expenses arising from their use of the Service, violation of these Terms, violation of third-party rights, violation of law, their User Content causing damage, or unauthorized use of their account.
16. International Operations & Compliance
The Service is accessible globally. Users are responsible for ensuring their use complies with all local laws, including employment, anti-discrimination, and data privacy laws (e.g., GDPR, CCPA).
17. Modifications to Terms
TurboApplication may modify these Terms at any time with reasonable advance notice for material changes. Continued use after revisions become effective constitutes acceptance.
18. Governing Law and Dispute Resolution
- Governing Law: These Terms are governed by and construed in accordance with the laws of Italy and the European Union, without regard to conflict of law principles.
- Dispute Resolution:
- Informal Resolution: The parties will first attempt to resolve any disputes through good faith negotiations.
- Court Jurisdiction: Any disputes that cannot be resolved informally will be resolved exclusively in the competent courts of Turin, Italy.
- European Consumer Rights: Nothing in these Terms affects the statutory rights of consumers under applicable European Union or Italian consumer protection laws.
19. Miscellaneous
- Entire Agreement: These Terms, the Privacy Policy, and any DPA constitute the entire agreement.
- Severability: If any provision is invalid, the remaining provisions remain in effect.
- Waiver: Failure to enforce a right is not a waiver. Waivers must be in writing.
- Assignment: Users may not assign Terms without consent. TurboApplication may assign Terms without restriction.
- Notices: Notices will be in writing via email or posting to the Service.
- Force Majeure: Neither party is liable for failure to perform due to causes beyond reasonable control.
- Headings: For convenience only.
